Terms & Conditions

1. Information on how to enter and prizes form part of these conditions of entry. Entry into the promotion is deemed acceptance of these conditions of entry.

2. Entry is open to all permanent residents of Australia 15 years or older except employees of the promoter and the promoter's agents and the immediate family of those employees. Entrants under the age of 18 must have consent of parent or guardian to enter this competition.

3. The promotion commences on 7/4/08 at 09.00am AEST and concludes on the 17/5/08 at 18:00 AEST. (“Promotion Period”)

4. Entries will be deemed to be accepted at the time of receipt and not at the time of transmission. Incomplete or incomprehensible entries will be deemed invalid. Any entries received after the date 17/5/08 at 18:00pm (AEST) are ineligible for the draw and no responsibility will be accepted for late, lost or misdirected entries.

5. To enter, the entrant must register at www.mytickets.com.au/competitions/movies, unless previously registered, and submit this entry by the mechanic provided on the MyTickets website. The individual will then receive one entry into the prize draw.

6. The entrant may also enter the name and email address of multiple friends to receive additional entries into the prize draw for every email address provided. Entrants may not refer themselves and doing so will disqualify that individual’s entry.

7. Entrants can only enter their own name and use their own email address. Entrants may only fill out one form per person. Multiple forms entered by the same person will not be accepted. The Promoter reserves the right to request winners to provide proof of age, identity and proof of residency and/or proof of entry validity. Proof of identification, residency and entry considered suitable for verification is at the discretion of the Promoter. The Promoter reserves the right to validate and check the authenticity of any prize claim or entry before awarding the prize.

8. The Promoter is entitled to confirm that referrals that resulted in the entrant obtaining additional entries into the draw are genuine, in that there is not a substantial number of hard bounces when confirming the authenticity of the referral email addresses. The Promoter will investigate authenticity for each winner of the competition.

9. The Promoter, in its absolute discretion, reserves the right to verify the validity of all entries and to disqualify any entrant who tampers with the entry process, or who submits an entry that is not in accordance with these Conditions of Entry.

10. The prize draw will take place at Level 10, 45 Market St, Sydney NSW on 19/5/08 at 10am. The prize winners will be the first 50 valid entries drawn from a computer generated list of entries. The prize winners will be notified by email and/or telephone within 2 working days of the draw and the winner’s details will be published in the public notices section of The Australian newspaper on the 30/5/08. Winner’s details will also be published on the Movies Promotion competition page on the MyTickets website. The result of the draw is final and no correspondence will be entered into.

11. There will be 50 individual prizes to be won during the MyTickets Movies Promotion period. Each individual prize consists of one year’s worth of double movie passes to Sony Pictures Releasing films. The total prize pool is valued up to a maximum of $21,450 including GST with each individual prize valued up to a maximum of $429 including GST (based on 13 double movie passes valued up to a maximum of $33 each).

12. Prize values are GST inclusive and are in Australian dollars and are the maximum retail price as provided by the supplier and are correct at time of publishing these terms and conditions. The promoter accepts no responsibility for any variation in prize value.

13. Movie passes will be delivered to the winners throughout the year as they become available from Sony Pictures Releasing.

14. Should a prize remain unclaimed, an unclaimed prize draw will take place no sooner than 1 month from the original draw date (19/6/08) at 10am. The prescribed period of 1 month has been determined to ensure that the movie passes can be delivered to the winners before the release of the first movie for which the movie passes are being issued. The re-draw will take place at the same location as the original draw. The winner will be notified by email within 2 working days of the draw and the winner’s details will be published in the public notices section of The Australian newspaper on the 27/6/08.

15. In the event that the unclaimed winner is from South Australia, a redraw will take place to distribute any unclaimed prizes subject to any written directions given under Reg. 37 of the Lottery and Gaming Regulations, 1993 (SA).

16. The prizes are not redeemable for cash. Prizes are subject to availability at the time of redemption. Actual movie passes may differ from those pictured. Prizes are transferable to another person nominated by the winner if the winner is unable to take the prize. Normal ticket terms and conditions apply to the prizes.

17. In the event that for any reason whatsoever a winner does not take an element of the prize at the time stipulated by the Promoter then that element of the prize will be forfeited by the winner and cash will not be awarded in lieu of that element of the Prize.

18. The winner agrees to the use of their name, image and photograph/s for publicity and promotional purposes, without compensation, and agrees that the Promoter will own copyright of any such images and photograph/s and in all material incorporating the photograph/s.

19. The Promoter’s decision in relation to any aspects of the competition is final and binding on every person who enters and no correspondence will be entered into.

20. The Promoter shall not be liable for any loss or damage whatsoever which is suffered (including but not limited to indirect or consequential loss) or for any personal injury suffered or sustained in connection with any prize/s except for any liability which cannot be excluded by law.

21. The Promoter is not responsible for any incorrect or inaccurate information, either caused by the website user or for any of the equipment or programming associated with or utilised in this competition, or for any technical error, or any combination thereof that may occur in the course of the administration of this competition including any omission, interruption, deletion, defect, delay in operation or transmission, communications line or telephone, mobile or satellite network failure, theft or destruction or unauthorised access to or alteration of entries.

22. The Promoter reserves the right in its sole discretion to disqualify any individual who the Promoter has reason to believe has breached any of these conditions, or engaged in any unlawful or other improper misconduct calculated to jeopardise the fair and proper conduct of the promotion. The Promoter’s legal rights to recover damages or other compensation from such an offender are reserved.

23. All entries become the property of The Promoter. All entries will be entered into a database and The Promoter & promotional partners will retain this information and may use the entrant’s names & email addresses for future promotional, marketing and publicity purposes in any media worldwide without notice, unless otherwise advised by the entrant. Please note that at the bottom of any communication distributed by The Promotion there will be an ‘unsubscribe’ link, which if selected by the recipient, will result in the Promoter immediately ceasing to send any communications to the recipient. By entering the promotion, entrants confirm that they allow their details to be used for this purpose. If entrants do not consent to their details being used for future marketing purposes, the entrant should contact The Promoter on their details set out below. Any request to update, modify or delete the entrant’s details should be directed to The Promoter.

24. If for any reason this promotion is not capable of running as planned, whether caused by infection by computer virus, mobile phone failure, line drop out, bugs, tampering, unauthorised intervention, fraud, technical failures or any other cause beyond the control of the Promoter which corrupt or affect the administration, security, fairness or integrity of the promotion, the Promoter reserves the right in its sole discretion, (subject to state regulations), to cancel, terminate, modify or suspend the promotion.

25. In the case of the intervention of any outside agent or event which naturally changes the result or prevents or hinders it's determination, including but not limited to vandalism, power failures, tempests, natural disasters, acts of God, civil unrest, strikes, War; the Promoter may in its absolute discretion cancel the event and recommence it from the start on the same conditions subject to State Regulation. 26. Any tax liability arising as a result of accepting the prize is the responsibility of the winner.
